The Legal framework for the jobs of trade Union in Iraq - Analytical study

Abstract

The idea of the research is summarized in the functions performed by labor unions in Iraq, and determining the legal framework for these functions in Labor Law No. (37) of 2015, as labor unions enjoy some specializations and practice various functions that extend to different social, economic, political and other fields. These functions are among the most important issues that determine the strength and effectiveness of unions, because recognition of unions and granting them legitimacy are not goals as much as they are means to enable unions to perform their tasks and provide them with the opportunity to defend the interests of their members and care for them from the economic, political, social, professional and cultural aspects. This study aims to examine the reality of labor unions in Iraq, with the goal of identifying ways to activate their role in developing their assigned functions in general. The focus was on these functions in general, and these functions were addressed in terms of the theoretical framework upon which they are based, represented by the constitution, laws, regulations, and internal instructions. Their contribution to the implementation of labor law issues was then addressed through a study of the relevant texts. The primary objective of examining these functions and contributions is to determine the effectiveness of labor unions in fulfilling their role, whether in the social and economic process or in political development, as well as their role in implementing labor law.
